Intensification of PH Custom Regulation Sec 201 of the Tariff and Customs Code
Since July 2010, Philippines Customs has been intensifying its efforts to implement Regulation Sec 201 of the Tariff and Customs Code of the Philippines, Republic Act 9135. The regulation allows Customs to question or doubt the truth or accuracy of value declarations.
As a result, some inbound shipments to the Philippines may experience customs delays.
To avoid such delays, we encourage customers to provide proof or evidence of payment or other documents to support their invoice value. Proof of payment includes such items as bank receipts, letters of credit and purchase orders.
If no documents or evidence can be presented, and if the importer does not agree to re-valuation by Customs, the entry will be referred to the Valuation & Classification Review Committee, whose findings will be final and binding.
