            The FedEx Office Convening Leaders Art Giveaway (the “Sweepstakes”) is sponsored by FedEx Corporate Services, Inc., 3875 Airways, Module H3 Department 4634, Memphis, TN 38116 (“Sponsor”) and administered by PrizeLogic, LLC, 25200 Telegraph Road Suite 405, Southfield, MI 48033, an independent judging agency (“Administrator”).

1.  DEFINITIONS AND SWEEPSTAKES OVERVIEW: 

(A)       The Sweepstakes starts Dec. 19, 2011, at 12 a.m. Eastern Time in the U.S. (“ET”) and ends Jan. 13, 2012, at 11:59:59 p.m. ET (the “Sweepstakes Period”). The Administrator’s computer is the official Sweepstakes clock.

(B)       If you’re an eligible entrant under these Official Rules, you may enter the Sweepstakes by going to fedex.com/conveningleaders (the “Website”), and completing the registration form by submitting your complete first and last name, email address, business name, hotel or convention center name (if applicable), and complete business address. To be entered into the Sweepstakes you must also complete the accompanying survey (the “Survey”).

(C)       You may only enter once during the Sweepstakes Period.

2.  ELIGIBILITY: The Sweepstakes is open only to active members of PCMA, the Professional Convention Management Association, who (a) have been invited to participate in the Survey by Sponsor and (b) are at least eighteen (18) years of age, or the age of majority in the jurisdiction of residence, whichever is greater. No one else is eligible to enter or win. Void where prohibited or restricted by law. 

3.  SWEEPSTAKES DRAWING, PRIZES AND ODDS OF WINNING.

(A)       RANDOM DRAWING: On or about Jan. 18, 2012, the Administrator will randomly select three (3) potential winners from among all eligible entries received during the Sweepstakes Period. The potential winners are subject to verification and compliance with these Official Rules.

(B)       PRIZE: 3 Prizes in total will be available. Each winner will receive one (1) 24" x 36" reproduction of an original painting by Erik Skoldberg. Approximate Retail Value (“ARV”) of each painting is USD $150.00 for each painting. Total ARV of all available prizes is USD $450.00.

The potential winners will be notified via email and/or phone on or about Jan. 20, 2012. The potential winners may be requested to sign an Affidavit of Eligibility & Liability Release, Declaration of Eligibility and/or other documents, where legal, required to confirm the potential winners’ eligibility to receive a prize. Documents must be returned in accordance with Sponsor’s instructions or the potential winner will be disqualified and the Prize may be awarded to an alternate winner in the Sponsor’s sole and absolute discretion. Sponsor will not be obligated to make more than three (3) attempts to award a Prize. If, after three (3) such good faith attempts, Sponsor is unable to award a Prize, then Sponsor, in its sole and absolute discretion, may or may not award the Prize.

Sponsor reserves the right to substitute a prize of equal or greater value if advertised prize is unavailable. No substitution or transfer of prize by entrant is permitted. All taxes related to the prize are the winner’s responsibility.

(C)       ODDS OF WINNING: The odds of winning the Prize depend upon the total number of eligible entries received.

4.  LIMITATIONS OF LIABILITY/INTERNET: Sponsor, Administrator, PrizeLogic, Hanley Wood Marketing and their respective parent, subsidiary and affiliate companies (collectively, “Sponsor & Others”) are not responsible for illegible, lost, late, incomplete, stolen, misdirected, postage-due or undeliverable email or postal mail; or for any computer, telephone, satellite, cable, network, electronic or internet hardware or software malfunctions, failures, connections or availability; or garbled, corrupt or jumbled transmissions, service provider/internet/website/Usenet accessibility, availability or traffic congestion; or any technical error, or unauthorized human intervention; or the incorrect or inaccurate capture of registration information, or the failure to capture, or loss of, any such information. Sponsor & Others are not responsible for any typographical or factual errors, or incorrect or inaccurate information or answers, whether caused by any website users, tampering, hacking, or any of the equipment or programming associated with or utilized in the Sweepstakes or Survey; and assume no responsibility for any omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical or factual error, theft or destruction, or unauthorized access to any website(s). Additionally, Sponsor & Others bear no liability for acts of force majeure or other acts which result in a cancellation or delay of the Sweepstakes or any part of the Sweepstakes, or otherwise interfere with the intended proper administration, operation and fulfillment of this Sweepstakes. Sponsor & Others are not responsible for any injury or damage, whether personal or property, to entrants' or to any person's computer related to or resulting from participating in this Survey or Sweepstakes. If, for any reason, the Survey or Sweepstakes is not capable of running as planned, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and/or proceed with the Sweepstakes in a manner deemed fair and appropriate by Sponsor, including the selection of winners from among eligible entries received prior to said cancellation, termination, modification or suspension. In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be declared made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor reserves the right to disqualify any individual found, in its sole opinion: to be tampering or attempting to tamper with the operation of the Survey or Sweepstakes; to be acting in violation of these Official Rules, including attempting to participate in the Survey or Sweepstakes more than once daily; to be acting with the intent to disrupt the normal operation of this Survey or Sweepstakes; or to be otherwise acting in an unsportsmanlike manner. Any use of robotic, automatic, macro, programmed, third-party or like methods used to participate in the Survey or Sweepstakes will void any attempted participation effected by such methods and will disqualify the individual utilizing the same.

6.  RELEASE: By acceptance of a Prize, the winner releases and agrees to indemnify and hold harmless Sponsor & Others from and against any and all costs, claims, damages or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to participation in the Survey or Sweepstakes, or arising out of participation in any Survey or Sweepstakes, or the receipt, use or misuse of any prize.
7.   GENERAL:  Entering this Sweepstakes constitutes the entrant’s full and unconditional agreement to these Official Rules. The decisions of Sponsor and/or Administrator are final and binding in all matters pertaining to this Survey and Sweepstakes. In no event will more prizes be awarded than are stated in these Official Rules. In the event that due to technical, typographical, printing, mechanical or other errors, there are more potential prize winners than are stated in these Official Rules, a random drawing among the claimants will be held to determine the winners. Subject to all applicable federal, state, provincial and local laws and regulations. Except where prohibited, by participating in the Sweepstakes, participants agree that: (a) except as otherwise specifically set forth in these Official Rules, any action arising out of or relating to these Official Rules or the rights and obligations of any entrant and/or Sponsor shall be filed exclusively in the United States District Court for the Western Eastern District of Tennessee (Western Division) or the appropriate Tennessee State Court located in Shelby County, Tenn.; and entrants hereby consent and submit to the personal jurisdiction of such court for the purposes of litigating any such action, and any right to a trial by jury is hereby waived; (b) any and all disputes, claims, and causes of action arising out of or connected with these Official Rules, and/or the rights and obligations of any entrant and/or Sponsor, shall be resolved individually, without resort to any form of class action; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and in no event will entrants be entitled to receive attorneys' fees or other legal costs; (d) under no circumstances will entrants be permitted to obtain injunctive or other equitable relief, and an entrant's sole remedy will be an action at law for damages to the extent allowed by sub-paragraphs (c) and (e) of this Rule 9; and (e) under no circumstances will entrants be permitted, and entrants hereby waive all rights, to: (i) claim punitive, exemplary, special, incidental, indirect and consequential damages and any other damages (whether due to negligence or otherwise), other than for actual out-of-pocket costs described in (c) above; and (ii) have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and/or Sponsor, shall be governed by and construed in accordance with the laws of the State of Michigan without giving effect or regard to any principles or doctrines of conflicts of law of the State of Michigan or any other jurisdiction. If any provision or provisions of these Official Rules shall be held to be invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby. All entries become property of Sponsor and will not be returned.
