TERMS AND CONDITIONS

Ship Again with FedEx (“Promotion”)

(Reactivation Program, Cambodia)

1. “Promotion” refers to Ship Again with FedEx Campaign.

2. By submitting an entry into this Promotion, you will be deemed to accept these Terms and Conditions.

3. The promotion period is from 15 October 2022 at 12:00am Cambodia Time and concludes at 11:59pm Cambodia Time on 31 December 2022, both days inclusive (“Promotion Period”).

4. Entry to Promotion

a. Entry into this Promotion is open to residents of Cambodia (“Participants”);

5. This Promotion is applicable to Participants who meet the below requirements:

a. Participants must be an existing FedEx customer with valid corporate account without any shipment for 3-9 months;

6. Incentives and Tiers

a. Tier 1. Participants with FedEx corporate account who make 1 shipment within the promotion period (shipping online via FedEx Ship Manager at fedex.com) and pay for the shipment on time will be entitled to receive one (1) FedEx Limited Edition Laptop Bag; or

b. Tier 2. Participants who make 2 shipments within the promotion period (shipping online via FedEx Ship Manager at fedex.com) and pay for the shipment on time will be entitled to receive one (1) FedEx Limited Edition Neck Pillow.

7. The Promotion cannot be used in conjunction with any other offer provided by FedEx Express.

8. FedEx Express reserves the right to replace the rewards stated herein with other items of equivalent value without notice. The rewards cannot be exchanged for cash, cash-equivalents or any other gifts, goods or service of value.

9. FedEx Express shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss), for personal injury which is suffered or sustained, or for tax implications that may arise from accepting any of the rewards, except for any liability which cannot be excluded by law.

10. Eligibility excludes the directors, management and employees (and their immediate families) of FedEx Express, its related entities, printers, suppliers, providers and agencies associated with the Promotion as well as employees, agents and representatives of any government department or any government owned entity or any juristic person funded by any government department.

11. By entering the Promotion, unless otherwise advised by the entrant, each entrant consents to the information they submit being entered into a database which may be used by FedEx Express in any media for future promotional and publicity purposes.

12. The terms and conditions of carriage in the applicable FedEx Express Air Waybill and the Customer Service Agreement, in effect on the day of any shipment, shall apply to the shipment. If there is a conflict between the terms of the FedEx Express Air Waybill/ Customer Service Agreement and these Terms and Conditions, the former will prevail.

13. In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the Promotion, these terms and conditions will prevail.

14. If the Promotion is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of FedEx Express, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, FedEx Express reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion.

15. In the event of any discrepancies with respect to the Promotion, the FedEx Express decision is final and no other correspondence will be accepted.

16. FedEx Express reserves the right to amend these Terms and Conditions at any time without notice.

17. FedEx shall not be liable for any loss or damage (including but not limited to indirect or consequential loss) which is suffered by a participant or other parties in connection with this Promotion, including but not limited to personal injury and tax obligations that may arise from accepting any of the rewards, except for any liability which cannot be excluded by law.

18. Eligibility excludes the directors, management and employees (and their immediate families) of FedEx, its related entities, printers, suppliers, providers and agencies associated with the promotion stated herein as well as employees, agents, officers, and representatives of any government department, government owned entity, juristic person funded by any government department, political party or public international organization, or any candidates for political office.

19. FedEx reserves the right to require the participant(s) to execute a certificate of eligibility prior to awarding the participant(s) with the prize, confirming that the participant is not excluded from entry into this Promotion pursuant to these Terms and Conditions and that the participant(s) has complied fully with these Terms and Conditions. Truthful completion of this certificate is a precondition to the award of the rewards.

20. By entering this Promotion, unless otherwise advised by the participant, each participant consents to the information they submit being entered into a database which may be used by FedEx in any media for future promotional and publicity purposes specific to this Promotion only.

21. The terms and conditions of carriage in the applicable FedEx Express Air Waybill, in effect on the day of any shipment, shall apply to the shipment. If there is a conflict between the terms of the FedEx Express Air Waybill and these Terms and Conditions, the former will control.
