Terms and Conditions

“FedEx Ship and Save Campaign("Campaign")

Agreement

 This section sets out the terms and conditions of the FedEx “Ship and Save” Campaign (the "Campaign").

 You (hereinafter referred to as "You", "Your", "Customer", or "Participant") agree that the terms and conditions provided in this agreement ("Agreement") govern your participation in the ("Campaign").

Your eligible account number, as determined by FedEx has been pre-enrolled for the Campaign.

The account in the invitation email is pre-enrolled in the Campaign. By tendering an Eligible Shipment using that account during the Promotion Period, the Participant agrees to be bound by the campaign’s terms and conditions.

This Campaign is undertaken only for the reason of promotion of goodwill and is in no way intended to improperly influence the Participant to act in a way where they otherwise would not have taken such action.
 

Campaign Period (“Campaign Period”)

The Campaign Period is stated in the email notification from FedEx to you and will end on a date to be determined by FedEx. You will be notified of the Campaign end date via email from FedEx.
 

Entry to Campaign

1. Entry into this Campaign is open to existing FedEx account holders who receive an invitation email from FedEx to participate in the Campaign (“Participants”).

2. A holder of a cash account or deleted account is not eligible for this Campaign.

3. If a Participant is a FedEx business account, then an individual person may be nominated as its representative ("Nominated Representative") and enter on the Participant's behalf, but not in his/her own name or on his/her own behalf. Only one Nominated Representative is permitted per Participant.

4. FedEx accepts no responsibility for any late, lost or misdirected entries including delays in the delivery of an entry due to technical disruptions, network congestion or for any other reason.

5. If the Participant does not want his/her personal information to be utilized by FedEx for further promotional or direct marketing activities, the Participant may click the unsubscribe link at the bottom of any FedEx email notifications
 

FedEx e-Shipping Voucher

1. Participants who have an active FedEx account that is not suspended, restricted, designated as cash-only, or otherwise in breach of applicable account terms (in good standing), as determined by FedEx are eligible to participate

2. A Participant will receive a e-shipping voucher subject to following:

1. NAD 370 e-voucher on first shipment done within 30 days of the invitation email
2. NAD 560 on third shipment done within 60 days of the invitation email

3. The FedEx e-Shipping Voucher is only valid for redemption during the period specified on it.

4. The FedEx e-Shipping Voucher can only be redeemed once by the intended recipient and is good for its value to offset freight service charges against one (1) FedEx invoice. It cannot be used to offset payment for duties, taxes, ancillary charges, surcharges (including, but not limited to, dynamic fuel surcharges), handling or billing fees.

5. The FedEx e-Shipping Voucher must be submitted to: SSAfrica-CashApps@fedex.com.

6. Any remaining balance of payment due to FedEx should be paid before the invoice due date.

7. A FedEx e-Shipping Voucher with incomplete/incorrect invoice number will not be processed.

8. The FedEx e-Shipping Voucher cannot be used for cash-prepaid shipments.

9. The FedEx e-Shipping Voucher, including any unused value cannot be exchanged for cash, cash equivalents or any other gifts, goods or services of equal value.

11. The number of Eligible Shipments is determined based on the number of air waybills. One air waybill is equivalent to one shipment.

12. Pooling of shipments from multiple accounts is not permitted and such pooled shipments are not eligible to earn rewards in this Campaign.

13. FedEx reserves the right to replace to substitute the voucher with an alternative rewards or promotional benefit of equivalent value.

14. The FedEx e-Shipping Voucher will be emailed to a Participant.

15. Eligible Shipments” means shipments which satisfy all the following requirements:

1. International Priority (IP), International Priority Freight (IPF), FedEx International Economy (IE) or FedEx International Economy Freight (IEF) shipments;
2. Shipments tendered to FedEx during the Campaign Period (i.e. shipments tendered to FedEx by a Participant before the end of the Campaign Period as notified by FedEx );
3. Shipments billed to a Participant’s FedEx account (as indicated in the Campaign invitation email from FedEx) and paid in full during the Campaign Period.
    

General Terms and Conditions

1. Only the targeted accounts as determined by FedEx will qualify for the Promotion.  Discount will not apply to multiple FedEx accounts.

2. FedEx shall not be liable for any loss or damage (including but not limited to indirect or consequential loss) which is suffered by a participant or other parties in connection with this Promotion, including but not limited to personal injury and tax obligations that may arise from accepting any of the rewards, except for any liability which cannot be excluded by law.

3. A Participant is not eligible to redeem or receive a voucher if any invoice associated with the participating FedEx account is overdue at the time the voucher is issued or redeemed

4. Except as otherwise expressly provided in these Terms and Conditions, FedEx's determination regarding eligibility for and administration of the Campaign shall be final.

5. Eligibility to participate excludes the directors, management and employees (and their immediate families) of FedEx , its related entities, suppliers, subcontractors, FedEx Worldwide Service Account service providers and agencies associated with the Promotion  stated herein as well as employees, agents, officers, and representatives of any government department, government owned entity, juristic person funded by any government department, political party or public international organization, or any candidates for political office

6. FedEx reserves the right to require a Participant to execute a certificate of eligibility prior to awarding them with the Promotion reward, confirming that the Participant is not excluded from entry into this Promotion pursuant to these Terms and Conditions and that the Participant has complied fully with these Terms and Conditions. Truthful completion of this certificate is a precondition to the award of the Promotion rewards.

7. In the event of any inconsistency between these Terms and Conditions and any brochure, marketing or Promotional material relating to this Promotion, these Terms and Conditions will prevail.

8. By entering this Promotion, each participant consents to the information he or she submits being entered into a database which may be used by FedEx in any media for future Promotional and publicity purposes in accordance with the FedEx privacy policy.

9. If this Promotion is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures, and any other causes beyond the control of FedEx, which corrupt or affect the administration security, fairness, integrity or proper conduct of the Promotion, FedEx reserves the right in its sole discretion to cancel, terminate, modify, or suspend this Promotion.

10. The terms and conditions of carriage in the applicable FedEx Air Waybill, in effect on the day of any shipment, shall apply to the shipment. If there is a conflict between the terms of the FedEx Air Waybill and these Terms and Conditions, the former will control.

11. In the event of any disagreement between a Participant and FedEx with respect to interpretation of these Terms and Conditions, the decision made by FedEx will be final and no other further correspondence will be accepted. FedEx will not be obliged to apply the FedEx e-Shipping Voucher if it is contrary to any applicable laws or regulations.

12. FedEx reserves the right to amend these Terms and Conditions at any time without notice.

13. No liability can be attributed to FedEx in the event of improper use by the Participant of the prizes or use by people who are unsuitable due to age or physical/mental conditions.

14. FedEx shall not be liable for any malfunction, defect or issue faced with any product(s) or service(s) issued hereunder as prizes for this Promotion. All guarantees and limitations issued by the supplier in relation to such product(s) and service(s) shall apply.

15. By participating in the Promotion, Participants hereby consent to FedEx and their authorized agents, service providers and business/Country/ Marketing partners to collect, use, disclose, transfer and share the personal data Participants have provided (including across jurisdictions) for:

1. purposes of conducting and administering the Promotion.
2. relationship management, sales, marketing, advertising, and Promotion purposes as well as any other purpose as authorized by Participants, or as otherwise required or permitted by law.

16. Participants also agree that: (i) the consent herein overrides any earlier withdrawal of Participants' consent and will remain effective unless such the consent herein is withdrawn; (ii) the consent herein does not supersede or replace any other consents which Participants may have provided to FedEx, their authorized agents, service providers and/or business/Country/ Marketing partners; and (iii) FedEx, their authorized agents, service providers and/or business/Country/ Marketing partners may contact Participants via any mode and media about products and services offered by FedEx regardless of Participants' registration(s) with any do not contact/call registry as per applicable law.

19. In addition, Participants hereby represent and warrant that Participants are the user and/or subscriber of the contact details provided by Participants as part of the Promotion.
 

Shipments

The terms and conditions of carriage in the applicable FedEx Service Guide, in effect on the day of any shipment made by the Participant under the Campaign, shall apply to any such shipments (‘Conditions of Carriage’). If there is a conflict between the Conditions of Carriage and the Campaign, the Conditions of Carriage will hold.
 

Complete Agreement

This Agreement, together with the Conditions of Carriage and Account Terms and Conditions, constitutes the entire agreement in place with the customer and supersedes any prior or contemporaneous understandings, representations, statements or agreements, written or oral. No amendment to, modification of, or waiver of any provision of, this Agreement will be binding on FedEx without FedEx's written consent.
