Declaration of Established Business Relationship (EBR)

In May 2025, the European Commission introduced a new implementing regulation relating to aviation security. This follows the introduction of similar restrictions by some non-European countries on shipments travelling by air from Europe.

A simple one-time statement from you, as an intermediary who books shipments on behalf of shippers, allows us to comply with the new regulation.

Not meeting this requirement means all shipments from you as an intermediary would be considered non-EBR and treated accordingly, which may have a negative impact on acceptance and processing.

Background

One particular requirement of the new regulation relates to the relationship between regulated agents (i.e. FedEx) and shippers (i.e. your customers). In order to confirm that an Established Business Relationship (EBR) exists, a regulated agent must now obtain specific information from the shipper or consignor, or from the freight paying consignee (i.e. you as intermediary). Regulated agents must distinguish between EBR and non-EBR shipments and handle and screen them accordingly. Where there is an intermediary involved between the original shipper and the regulated agent, additional verification is required.

The information required to demonstrate an EBR after 1 September 2025 is: Personal, business or corporate contact details; payment information (e.g. bank account or traceable credit card number); VAT number, company registration certificate, if applicable; and a contractual agreement.
