KYC (Know Your Customer) “Authorization”, “Declaration” and “Privacy Statement” (collectively, “Terms and Conditions”)

1. Authorization

Authorization regarding Know Your Customer (KYC) Documents and Processes (“Authorization”)

I/We hereby authorize FedEx Express Transportation and Supply Chain Services (India) Private Limited, Federal Express Corporation and each of their affiliates (together hereinafter referred as “FedEx”, which expression shall include their respective holding companies and their customs clearance agents/brokers, being Sun Impex Clearing & Shipping Agency Private Limited and Jeena & Co) to:

1) act as our authorized courier and/or agent to do all necessary acts on our behalf for customs clearance including filing of documents, declarations and Bills of Entry/Shipping Bills for clearance of all import and export shipments consigned to or by us from time to time through the courier/express or formal customs clearance mode.

2) File documents for import and export customs clearance of shipments based on the declaration and information regarding the shipments provided to FedEx by us or in the absence of the same, the information for import shipments provided to FedEx by the consignors for delivery in India.

a) Act in capacity of transporter of goods by FedEx or contractual logistics partner, to generate E-Way Bill 01 Part A for forward movement as well reverse movement if in case the shipment is not delivered at the manifested address or if the consignee [Importer of Records (IOR)] refuses acceptance of shipment. We also undertake to provide delivery for reverse movement as per the allowed provisions of laws applicable to E-Way bills for shipments of landed value greater than INR 50,000,

I. E-Way Bill Part A comprising details of Goods and Services Tax Identification Number (GSTIN) of recipient, place of delivery (PIN Code), invoice or delivery challan number, bill of entry number and date, value of goods, HSN code, transport document number (Air Waybill number) and reasons for transportation; and

II. E-Way Bill 01 Part B comprising transporter details (vehicle number).

3) Verify the address at the time of delivery and take a physical/electronic proof of delivery at the said address.

This Authorization shall remain valid until revoked in writing and acknowledged by FedEx in writing and shall cover all our shipments sent by or addressed to our various offices/ branches in India. This authorization shall be produced and presented before any customs authority at any of the customs station in India as a formal authorization to your company for customs clearance of our shipments by you or its authorized agents.

Please provide the following Know Your Customer (KYC) document, as applicable.

• In case of PAN Card (mandatory to provide any of the above mentioned documents for address proof)

IEC number is mandatory to file shipment for clearance. The name / branch address of company as on the invoice should match with that on shipping documents accompanying the shipment and in the IEC.

We/I undertake that all shipments tendered to FedEx are in compliance with the applicable FedEx Service Guide and Conditions of Carriage available on fedex.com.

We hereby further consent and authorize FedEx to use the Know Your Customer (KYC) documents submitted by us to TNT India Private Limited (TNT) for clearance of export and import shipments on our behalf.

We/ I duly declare that the above document is the true copy and verifiable with original KYC document if called upon by customs / government authorities. 

We/I hereby affirm to have read, understood and agree to these terms and conditions in accordance with below (“Electronic Signature Provision”):

a) We/I agree that these documents, and any documents to be signed in connection herewith, may be electronically signed and my use of an Electronic Signature shall, for the purposes of validity, enforceability and admissibility, be conclusive evidence of my intention to be legally bound as if such signature had been written by hand.

b) We/I understand and agree that an “Electronic Signature” shall mean data in electronic form which is attached to or logically associated with other data in electronic form and which is used by a signatory to sign and includes, without limitation, ‘click-wrap’ or ‘click-to-agree’ process, typing a name or other text, inserting a signature (in the form of an image) or using a web-based electronic signature platform to generate an electronic representation of a handwritten signature or a digital signature using public key encryption technology.

c) In the event that an Electronic Signature is, for any reason whatsoever, not recognized by any relevant person, entity or authority in any applicable jurisdiction, upon request of FedEx, We/I undertake to promptly provide a handwritten signature (including, where applicable, signed and sealed) on any relevant documents.

2. Declaration

Declaration regarding Know Your Customer (KYC) Documents and Particulars (“Declaration”)

I/We hereby declare that the particulars given herein are true, correct and complete. The documents uploaded on the website in support of Know Your Customer (KYC) Regulations, are true copy of the original. I/We undertake to notify you in writing in case of any change in the particulars/documents provided herein. I/We hereby authorize you to submit the above particulars to the customs and other regulatory authorities on my/our behalf as may be required in order to transport and customs clear all my/our shipments. 

I/We hereby further declare and confirm that:

• We are required to comply with all laws, all the provisions of the Customs Act, 1962 and the Rules, Regulations, Notification, Circulars and Orders made thereunder, including inter alia the Courier Imports and Exports (Electronic Declaration and Processing) Regulations, 2010, Courier Imports and Exports (Clearance) Regulations, 1998 and the amendments made thereto from time to time.

• Shipments tendered to FedEx directly or indirectly through the shipper shall be in compliance with all applicable laws.

• We are compliant with the FedEx Conditions of Carriage for our shipments and the ‘FedEx.com Terms of Use (https://www.fedex.com/en-in/terms-of-use.html)’ as updated from time to time for submission of information or documents to FedEx. 

• In relation to any data provided by us, we represent that we have complied with applicable laws, including obtaining the necessary legal basis (e.g. consent) for the provision of such data to FedEx and the processing by FedEx of the data. Where our consent is required, we expressly provide such consent to FedEx, including by accessing, using and/or submitting any data to FedEx, and/or continued use of FedEx services.

• We understand and agree that in any case where FedEx collects, transfers personal data (including across jurisdictions), handles, or otherwise processes personal data, such activities are governed by the applicable FedEx Privacy Policy and Notice(s), including as provided on https://www.fedex.com/en-in/privacy-policy.html.

• We are bound by this Declaration.

3. Privacy Statement

Privacy Statement regarding Know Your Customer (KYC) (“Privacy Statement”)

FedEx Express Transportation and Supply Chain Services (India) Private Limited ("FedEx") understands the importance of protecting the privacy of kyc.fedex.com users.

This Privacy Statement describes the type of information and data FedEx collects via kyc.fedex.com, FedEx Know Your Customer (KYC) registration website.

It will also describe how FedEx processes and uses the data, with whom the data is shared, how FedEx protects the data and how you can contact FedEx for any queries regarding your privacy.

This Privacy Statement is supplementary to, and to be read together with:

The following information and data is submitted by you for customs processing and clearance of your shipments:

VII. Know Your Customer (KYC) documents (any one from the list)

• Passport Number

• Permanent Account Number (PAN)

• Aadhaar Card Number

• Election ID Card Number (Voter card)

• Goods & Services Tax Identification Number (GSTIN)

• Unique Identification Number (UIN)

VIII. Your IP Address and other data pertaining to the machine, location and other data from where you access, use or submit or upload documents or information on kyc.fedex.com.

2. Purpose of Data Collection

We will use the information you provide to us for the following purposes:

a) Act as your authorized courier and/or agent to do all necessary acts on your behalf for customs clearance including filing of documents, declarations and Bills of Entry/ Shipping Bills for clearance of all import and export shipments consigned by you from time to time through the courier or cargo mode;

b) File documents for import or export customs clearance of shipments to Customs and other regulatory authorities based on the declaration and information regarding the shipments provided by you or in the absence of the same, the information for import shipments provided to FedEx by the consignors for delivery in India;

c) Verify, track and store the IP Address from which you make submissions or access the FedEx website and to use the same to verify your credentials;

d) To provide timely, reliable and value-added services to customers, including international express transportation, shipment tracking, customs brokerage, account management and billing, supply chain management, information management and technical support, e-commerce, and related services;

e) To establish a customer relationship and to communicate with you;

f) To process any transactions that you enter into with FedEx and respond to any enquiries you may have;

g) To provide, develop, implement and/or manage services, including materials, models and/or databases (including those relating to artificial intelligence, algorithms and/or machine learning), analytics and questionnaires that help us enhance our services;

h) To assist in law enforcement efforts, collect unpaid debts, perform credit reporting and rating functions, and protect the business interests of FedEx and its business partners and customers;

i) To manage and promote FedEx business activities;

j) To meet requirements imposed by law;

k) To personalize your repeat visits to the website, and to administer and improve our website;

l) Act in capacity of transporter of goods, and generate E-Way Bill 01 Part A as per the provisions of E-Way Bill Rules for shipments of landed value greater than INR 50,000: 

I. Part A comprising details of GSTIN of recipient, place of delivery (PIN Code), invoice or challan number and date, value of goods, HSN code, transport document number (Airway Bill Number) and reasons for transportation; and

II. Part B comprising transporter details (vehicle number); and/or

(m) Other purposes directly relating to any of the above, or as otherwise permitted by law.

4. Who we share your information with

Personal data will be kept confidential but, subject to the provisions of any applicable law, we may share your data with:

a) The Indian Customs and other regulators as required by law;

b) Appropriate persons in our parent and affiliated companies (which may be located within and outside India);

c) Credit reference agencies and other companies for use in credit decisions, for fraud prevention and to pursue debtors, and they may keep a record of any search that they do;

d) Any person, including agents, contractors or third-party service providers (within or outside the FedEx group, and which may be located within and/or outside India) who provides administrative, marketing, telecommunications, computer, payment or data processing or other services in connection with the operation of our business and provision of our products and services to you; and/or

e) Any government departments or other appropriate governmental or regulatory authorities. or if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our Terms of Use, Standard Conditions of Carriage, Service Guide, and other agreements, or to protect our rights, property, or safety and those of our customers or others; and

5. How we protect your information

We will make all reasonable arrangements to ensure that personal data in our possession or under our control are protected against unauthorized access, collection, use, disclosure, copying, modification, disposal or similar risks.

6. Consent / Legal Basis for Processing

In relation to any data provided by you, you represent that you have complied with applicable laws, including obtaining the necessary legal basis (e.g. consent) for the provision of such data to FedEx and the processing by FedEx of the data. Where your consent is required, you expressly provide such consent to FedEx, including by accessing, using and/or submitting any data to FedEx, and/or continued use of FedEx services.
