FedEx Malaysia 30th Anniversary Campaign (“Campaign”)

CAMPAIGN TERMS AND CONDITIONS

1. By participating in this Campaign, you will be deemed to accept these Terms and Conditions.

2. Campaign Period: This Campaign commences on October 1, 2023 at 00.00 Malaysia time and concludes on November 30, 2023 at 23.59 Malaysia time.

3. Enrollment and Eligibility

a. Entry into this Campaign is open to all FedEx customers who enroll to participate for the Campaign via the Campaign registration form (https://forms.office.com/r/pj3m5WCSnw) during the Campaign Period (“Participant”).

b. Enrollment in Campaign is not automatic. You must enroll to participate. Participants must satisfy certain requirements as determined by FedEx from time to time, both at the time of enrollment and throughout their participation in Campaign. FedEx reserves the right to disqualify a Participant should the Participant fail to meet or maintain any such Campaign requirement. These Campaign requirements are at the sole discretion of FedEx, need not be disclosed, and are subject to change without notice.

c. To participate in the Campaign, you must have a valid FedEx Account number.

d. FedEx will only accept one (1) entry into the Campaign per Participant. If there are multiple entries submitted by a Participant, the entry with the earliest date will be considered as the only valid entry and all other entries submitted by such Participant shall be void. If a Participant submits multiple entries on a single date, all such entries submitted by such Participant shall be void.

e. FedEx reserves the right to require a Participant to execute a certificate of eligibility at any time, confirming that the Participant is not excluded from entry into Campaign pursuant to the Terms and Conditions and that the Participant has complied fully with the Terms and Conditions. If requested by FedEx, truthful completion of this certificate is a precondition to the award of any Campaign rewards.

f. In the event that a FedEx Account holder is a company or an organization, the FedEx Account holder must nominate an individual person as its representative ("Nominated Representative") to enroll in the Campaign on its behalf, but not in his/her own name or on his/her own behalf. Any reward obtained through Campaign must be attributed to a FedEx Account holder itself and any personal receipt of the reward will be deemed as having legitimate full authorization from a FedEx Account holder. Only one Nominated Representative is permitted per FedEx Account holder.

g. Persons under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.

h. Incomprehensible, objectionable and incomplete entries will be invalid and will not be eligible for the Campaign.

i. FedEx accepts no responsibility for any late, lost or misdirected enrollment entries including delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.

j. To participate in this Campaign, Participants must ship an “Eligible Shipment” with FedEx. An “Eligible Shipment” is a shipment which meets all of the following requirements:

i. A shipment shipped using the following FedEx services: International Priority Express (IPE), International Priority (IP), International Priority Freight (IPF), FedEx International Economy (IE) or FedEx International Economy Freight (IEF) shipments; and

ii. The shipment must be tendered to FedEx and paid for in full during the Campaign Period.

4. Campaign Mechanics & Prizes

a. A Participant who ships an Eligible Shipment during the Campaign Period will receive the following lucky draw entries depending on the relevant shipment goal achieved:

i. A Participant who ships one (1) Eligible Shipment will receive one (1) lucky draw entry to stand a chance to win one of the Grand Prizes;

ii. A Participant who ships three (3) or more Eligible Shipments will receive two (2) lucky draw entries to stand a chance to win one of the Grand Prizes.

b. A Consolation Prize will be issued to every 30th Participant who has shipped at least one (1) Eligible Shipment. For illustration, the 30th, 60th, 90th Participant (and so on and so forth) who enrolls in the Campaign (determined in accordance with the date and time of enrollment into the Campaign) and ships an Eligible Shipment will each receive a Consolation Prize.

5. Details of Prizes

a. Grand Prize Packages:

i. 1st Prize (one winner): 4 Days 3 Nights Trip to Fukuoka, Japan for 2 persons valued at approximately MYR 16,500 (subject to change).

ii. 2nd Prize (one winner): 3 Days 2 Nights Trip to Phuket, Thailand for 2 persons valued at approximately MYR 4,500 (subject to change).

iii. 3rd Prize (one winner): 3 Days 2 Nights Local Trip to Redang Island, Malaysia for 2 persons valued at approximately MYR 2,700 (subject to change).

iv. Each Grand Prize Package includes the following:

(1) Return economy flights for two (2) persons (i.e., the winner and the winner’s chosen guest) from their country/territory of residence. All travel details will be discussed with the winner prior to being booked by FedEx. The foregoing flight tickets shall not apply in the event the winner of the 3rd Prize is a resident of Redang Island.

(2) Three (3) nights (for 1st Prize) / Two (2) nights (for 2nd and 3rd Prizes) shared accommodation for two (2) persons at a hotel, such hotel to be decided by FedEx in its sole and absolute discretion. The name and address of the hotel will be communicated to the winner by FedEx. Accommodation will be either a twin room or a double room, depending on availability. Breakfast for two (2) persons shall be provided the said hotel.

(3) All travel tickets and accommodation will be booked and confirmed by February 28, 2024. All trips are to be completed by June 30, 2024.

(4) For the avoidance of doubt, each Grand Prize Package does not include travel to and from the airport or railway station in the winner’s country/territory/city of residence and in the destination country. It is the responsibility of the winner and his/her guest to make their own travel and transport arrangements to and from their origin and destination airport or railway station.

(5) It is the responsibility of the winner and his/her guest to ensure they comply and meet all relevant travel requirements, including but not limited to passport, visa and insurance requirements. For the avoidance of doubt, other personal expenses incurred including but not limited to travel insurance, tips, additional food/drinks, hotel extras (such as minibar, telephone calls, beverages and movies) are not included in the Grand Prize packages and shall be at the winner’s and his/her guest’s sole expense.

(6) All values set out herein are inclusive of SST.

b. Consolation Prizes: 30 x AEON shopping vouchers worth MYR Two Hundred (MYR200) each.

c. A winning Participant shall only be eligible to receive one (1) prize under this Campaign across all prize categories. For illustration, a Participant who is selected to receive a Grand Prize package shall be ineligible to receive a Consolation Prize.

d. The issue, validity and redemption of any third-party issued voucher is subject to such other terms and conditions as may be imposed by the issuing party and Participants agree to be bound by such terms.

e. FedEx Express reserves the right to replace the reward stated herein with other items of equivalent value without notice.

f. Participants eligible for rewards will be notified by email sent to their registered email addresses as submitted via the Campaign registration form once the Campaign results are determined and audited.

g. A list of the Grand Prize winners’ names (with last name masked out) will be posted on the FedEx APAC Facebook page for purposes of announcing and congratulating the winners of the Campaign by January 26, 2024.

6. Grand Prize Lucky Draw Mechanism

a. The lucky draw for the Grand Prize winners will be held on January 19, 2024 from 13.00 to 15.00 (Malaysia time) at the FedEx Express Malaysia office located at Menara LGB, Level 21, 1, Jalan Wan Kadir, Taman Tun Dr Ismail, 60000 Kuala Lumpur, Malaysia. An appointed external auditor will witness the lucky draw proceedings and verify the winners.

b. The winners for the grand prize lucky draw will be selected at random from the pool of eligible Participants.

c. In the event any one of the following events occurs in respect of an eligible Participant selected to win any of the Grand Prize package, the Grand Prize package will be forfeited in respect of such Participant and allocated to another Participant in accordance with these Terms and Conditions:

i. Unavailability of or not being ablet to contact the Participant;

ii. Failure to provide any necessary requested documents for proving compliance with the eligibility criteria or Terms and Conditions of this Campaign;

iii. Submission of documentation which is non-compliant with the Terms and Conditions of this Campaign and/or provided after the applicable deadline;

iv. Lack of confirmation following checks conducted on the information submitted by a Participant;

v. Untruthful information provided by a Participant; or

vi. Failure to comply with these Terms and Conditions.

d. Should a winning Participant fail to comply with any of these Terms and Conditions, such Participant will be disqualified from the Campaign and from receiving any prizes and a replacement winner will be chosen in accordance with these Terms and Conditions.

7. Notification of Grand Prize Package Winners

a. Winners of the Grand Prize packages will be notified on or before January 26, 2024 via e-mail to the email address provided in the Campaign registration form. Winners must reply such notification email within three (3) days of receipt of the said e-mail and inform FedEx whether he/she will be accepting or declining their prize. Winners must response to FedEx via MYMKTG@fedex.com.

b. Once the accuracy of the information submitted by the winner has been verified, instructions for receiving the Grand Prize package will be further provided via e-mail.

c. FedEx will not be liable in the event should one of the following occur:

i. A selected winner’s email inbox is full;

ii. A selected winner’s email inbox has been deactivated;

iii. The e-mail address provided by a participant is non-existent, incorrect or incomplete;

iv. Incorrect and/or inaccurate information provided by any Participant including without limitation telephone numbers, e-mail addresses, street addresses or personal information; or

v. Delay or failure of any postal operator or of the internet, computer or any internet service provider.

d. All participants are solely responsible for managing his or her e-mail inbox including but not limited to checking their e-mail and complying with the instructions for redeeming the prize, taking the necessary security measures to prevent anyone else from having unauthorized access to his or her e-mail account.

8. Data Protection and Privacy

a. By participating in the Campaign, you hereby consent to Federal Express, its parent and affiliates (collectively “FedEx” for the purposes of this clause), and their authorized agents, service providers and business/marketing partners to collect, use, disclose, transfer and share the personal data you have provided (including across jurisdictions) for:

i. Purposes of conducting and administering the Campaign, including but not limited to publishing an announcement of the Campaign winners in accordance with Clause 5(g) above; and

ii. Relationship management, sales, marketing, advertising, and promotion purposes, which purposes include any other purpose as authorized by you, or as otherwise required or permitted by law.

b. You also agree that: (i) the consent herein overrides any earlier withdrawal of your consent; (ii) the consent herein does not supersede or replace any other consents which you may have provided to FedEx, their authorized agents, service providers and/or business/marketing partners; and (iii) FedEx, their authorized agents, service providers and/or business/marketing partners may contact you via any mode and media about products and services offered by FedEx regardless of your registration(s) with any do not contact/call registry. In addition, you hereby represent and warrant that you are the user and/or subscriber of the contact details provided by you.

9. General

a. FedEx shall not be liable for any loss or damage (including but not limited to indirect or consequential loss) which is suffered by a participant or other parties in connection with this Campaign, including but not limited to personal injury and tax obligations that may arise from accepting any of the discounts, except for any liability which cannot be excluded by law.

b. Eligibility excludes the directors, management and employees (and their immediate families) of FedEx, its related entities, printers, suppliers, providers and agencies associated with the promotion stated herein as well as employees, agents, officers, and representatives of any government department, government owned entity, juristic person funded by any government department, political party or public international organization, or any candidates for political office.

c. By entering this Campaign, unless otherwise advised by the participant, each participant consents to the information they submit being entered into a database which may be used by FedEx in any media for future promotional and publicity purposes.

d. If this Campaign is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures and any other causes beyond the control of FedEx, which corrupt or affect the administration security, fairness, integrity or proper conduct of the promotion, FedEx reserves the right in its sole discretion to cancel, terminate, modify or suspend this Campaign.

e. The terms and conditions of carriage in the applicable FedEx Express Air Waybill, in effect on the day of any shipment, shall apply to the shipment. If there is a conflict between the terms of the FedEx Express Air Waybill and these Terms and Conditions, the former will prevail.

f. In the event of any discrepancies, inconsistencies or inaccuracies with respect to this Campaign, FedEx's decision is final and no other further correspondence will be accepted.

g. FedEx reserves the right to amend these Terms and Conditions at any time without notice.
