Promotion Terms and Conditions

Terms and conditions of FedEx Promotion with Incentive (this “Promotion”)

1. By tendering shipments with the FedEx business account stated in the invitation promotional materials, you will be deemed to accept these Terms and Conditions.

Promotion Period (“Promotion Period”)

2. This Promotion period is stated in the invitation promotional materials that were sent to the invited FedEx account holders.

Entry to Promotion

3. Entry into this Promotion is open to existing FedEx business account holders who are invited by promotional materials during the Promotion Period (“Participants”).

4. A holder of cash account is not eligible for this Promotion.

5. FedEx will only accept one entry per Participant. If there are multiple entries per Participant, the earliest date of entry will be taken as the valid entry and the other entries will be void. If there are multiple entries with the same date per Participant, all the entries by the Participant will be void.

6. If a Participant is a FedEx business account holder, an individual person may be nominated as its representative (“Nominated Representative”) and enter on the Participant’s behalf, but not in his/her own name or on his/her own behalf. Only one Nominated Representative is permitted per Participant.

7. Persons under the age of majority in the applicable jurisdiction of this Promotion must obtain the prior permission of a parent or guardian over the age of majority to enter. The entry will be void without aforesaid permission.

8. FedEx accepts no responsibility for any late, lost or misdirected entries including delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.

9. If the Participant does not want his/her personal information to be utilized by FedEx for further promotional or direct marketing activities, the Participant may click the unsubscribe link at the bottom of any FedEx email notifications or contact the FedEx Customer Service team.

10. By participating in this Promotion, you acknowledge and agree to comply with the terms and conditions that are established by FedEx. If there are violations of the regulations and counterfeiters, FedEx has the right to cancel the winner’s eligibility.

Rewards: Selection and Notice of Rewards Recipient

11. A Participant who, during the Promotion Period, tenders Eligible Shipments (defined below); attains the revenue or shipping goal (as set out in the invitation promotional materials); and pays by the enrolled FedEx business account will receive the corresponding value of incentive as stated in the invitation promotional materials.

12. The top 20 winners who make most revenue during the Promotion Period shall receive a UEFA Champions League gift.

13. FedEx holds the sole discretion on the distribution of incentive and may terminate any distributions without notifying the Participants. In case of any dispute arising out of this Promotion, our decision shall be final and conclusive.

14. “Eligible Shipments” must meet all of the following requirements:

i. "Eligible Shipments" means the export or import shipments between Hong Kong SAR and the destination or origins as stated in the invitation promotional materials;

ii. Shipments are shipped under the specific FedEx service(s) that specified in the invitation promotional materials (if any).

iii. Shipments tendered to FedEx during the Promotion Period;

iv. Shipments billed to the Participant’s FedEx business account and paid in full during the Promotion Period;

v. For the location and region classification of FedEx, please visit www.fedex.com/global/choose-location.html.

15. The number of Eligible Shipments is determined based on the number of air waybills. One air waybill equals one shipment.

16. Pooling of shipments from multiple accounts is not permitted and such pooled shipments are not eligible to earn rewards in this Promotion.

17. FedEx reserves the right to replace the rewards stated herein with other items of equivalent value without notice.

18. The incentive, including any unused value, cannot be exchanged for cash, cash equivalents or any other gifts, goods or services of equal value.

19. FedEx will notify the winner with the prize of this Promotion via email or direct mail within 3 months after the end of the Promotion Period.

20. The pictures and information of the prizes are for reference only, the actual products shall be considered as final.

General Terms and Conditions

1. FedEx shall not be liable for any loss or damage (including but not limited to indirect or consequential loss) which is suffered by a Participant or other parties in connection with this Promotion, including but not limited to personal injury and tax obligations that may arise from accepting any of the rewards, except for any liability which cannot be excluded by law.

2. No liability can be attributed to FedEx in the event of improper use by the Participant of the aforementioned rewards or use by people who are unsuitable due to age or physical/mental conditions.

3. FedEx shall not be liable for any malfunction, defect or issue faced with any product(s) or service(s) issued hereunder as rewards for this Promotion. All guarantees and limitations issued by the supplier in relation to such product(s) and service(s) shall apply.

4. The Participants’ registration information and time for this Promotion recorded by the FedEx server are considered as final. If there is any technical problem with regard to any computers, communication tools and networks or any other factors beyond the reasonable control of FedEx leading to any delays, loss, errors or unrecognizable information of the Participants or prize notifications issued by the FedEx, FedEx is not liable to them and any resulted consequences. FedEx’s decisions are final.

5. Eligibility to participate excludes the directors, management and employees (and their immediate families) of FedEx, its related entities, printers, suppliers, providers and agencies associated with the promotion stated herein as well as employees, agents, officers, and representatives of any government department, government owned entity, juristic person funded by any government department, political party or public international organization, or any candidates for political office.

6. FedEx reserves the right to require the Participant(s) to execute a certificate of eligibility prior to awarding the Participant(s) with the prize, confirming that the winner is not excluded from entry into this Promotion pursuant to these Terms and Conditions and that the Participant(s) has complied fully with these Terms and Conditions. If requested by FedEx, truthful completion of this certificate is a precondition to the award of the rewards.

7. In the event of any inconsistency between these Terms and Conditions and any brochure, marketing or promotional material relating to this Promotion, these Terms and Conditions will prevail.

8. By entering this Promotion, you hereby consent to FedEx, its parent and affiliates (collectively “FedEx” for the purposes of this Clause 21), and their authorized agents, service providers and business/marketing partners to collect, use, disclose, transfer and share the personal data you have provided (including across jurisdictions) for purposes of conducting and administering the Promotion; and relationship management, sales, marketing, advertising, and promotion purposes, which purposes include any other purpose as authorized by you, or as otherwise required or permitted by law. You also agree that: (i) the consent herein overrides any earlier withdrawal of your consent; (ii) the consent herein does not supersede or replace any other consents which you may have provided to FedEx, their authorized agents, service providers and/or business/marketing partners; and (iii) FedEx, their authorized agents, service providers and/or business/marketing partners may contact you via any mode and media about products and services offered by FedEx regardless of your registration(s) with any do not contact/call registry.

9. By entering this Promotion, you hereby consent to Federal Express, its parent and affiliates (collectively “FedEx” for the purposes of this Clause 24), and their authorized agents, service providers and business/marketing partners to collect, use, disclose, transfer and share the personal data you have provided (including across jurisdictions) for purposes of conducting and administering the Promotion; and relationship management, sales, marketing, advertising, and promotion purposes, which purposes include any other purpose as authorized by you, or as otherwise required or permitted by law. You also agree that: (i) the consent herein overrides any earlier withdrawal of your consent; (ii) the consent herein does not supersede or replace any other consents which you may have provided to FedEx, their authorized agents, service providers and/or business/marketing partners; and (iii) FedEx, their authorized agents, service providers and/or business/marketing partners may contact you via any mode and media about products and services offered by FedEx regardless of your registration(s) with any do not contact/call registry. 10. If this Promotion is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures and any other causes beyond the control of FedEx, which corrupt or affect the administration security, fairness, integrity or proper conduct of the promotion, FedEx reserves the right in its sole discretion to cancel, terminate, modify or suspend this Promotion.

11. The terms and conditions of carriage in the applicable FedEx Air Waybill, in effect on the day of any shipment, shall apply to the shipment. If there is a conflict between the terms of the FedEx Air Waybill and these Terms and Conditions, the former will control.

12. In the event of any discrepancies with respect to this Promotion, the FedEx decision is final and no other further correspondence will be accepted. FedEx will not be obliged to award the rewards if it is contrary to any applicable laws or regulations.

13. FedEx reserves the right to issue new discounts, modify FedEx's List Rates, impose surcharges (including fuel surcharge) and amend, modify, or discontinue the Program at any time. FedEx will provide prior notice to participants of any change in the discounts or a discontinuance of the Program either by mail or a message sent by an electronic transmission. Please refer to the respective Nation/ Country’s FedEx website or FedEx Customer Service for any amendment or modification to FedEx List Rates, surcharges (including fuel surcharge) or other terms and conditions of the Program.

14. FedEx reserves the right to amend these Terms and Conditions at any time without notice.
