TERMS and CONDITIONS: Purple Powerplay
AGREEMENT

You (hereinafter referred to as "You", "Your", "Customer", or "Participant") agree that the terms and conditions provided in this agreement (“Agreement”) govern your participation in the Program.

Your eligible account number has been pre-enrolled for the Program.

By tendering shipments with the FedEx account stated in the Promotion invitation email (“Invitation Email”), you or in the case of a business account, a nominated representative on behalf of his/her company, will be deemed to have accepted these Terms and Conditions.

This Program is undertaken only for the reason of promotion of goodwill and is in no way an attempt to improperly influence the Participant to act in a way where they otherwise would not have taken such action.

It would be the responsibility of the participant to ensure that by participating in the Program, the Participant would not lead to breach of any applicable policy or law. The Participant understands that FedEx is not asking the Participant to make any decisions that are unethical or illegal or in violation of Participant’s own policies or any applicable laws.
Program Period (“Program Period”)

The Program commences on March 1, 2025, and concludes on April 15, 2025 (“Program Period”).

Rewards will not be extended to beyond the Program Period.
ENTRY TO PROGRAM

Entry into this Program is open to existing FedEx account holders who receive the Invitation Email(“Participant”).

A cash account holder is not eligible for this Program.
-
To qualify for this Program, Participants must ship and reach the assigned target/qualifier during the Program Period.

For the avoidance of doubt, the following accounts are not eligible to participate in this Promotion:

All decisions regarding eligibility to participate in the Promotion are solely within the discretion of FedEx.
-
Participants will receive personalised shipment targets in the program emailer.
-
By tendering Eligible Shipments to FedEx during the Program Period and meeting the personalized shipment targets, Participants can enter a lucky draw and stand a chance to win one of several prizes.

Eligible Shipments must meet all the following requirements:
-
Only shipments billed to a FedEx account owned by the Participant in India will be eligible for the reward program.
-
The number of Eligible Shipments is determined based on the number of air waybills. One FedEx air waybill equals one shipment.
-
Terms and conditions of the tickets provided to the Participant will apply over and above FedEx Terms and Conditions.
-
Participant will be solely liable and responsible for all, applicable tax, levies and/ or statutory deductions as a result of participation in this Program.

Super Strikers category winners will be determined by a lucky draw post the Program Period.
-
Only Eligible FedEx accounts meeting their personalized shipment target as outlined in the invitation email during the defined Program Period qualify for the lucky draw (only for Super Strikers category).

Orange Cap: Top 5 (Import) highest volume (absolute) to the target during the campaign period win 2 passes each for CSK players “Meet and Greet” event and FedEx | CSK branded merchandise worth up to INR 10,000

Customers should achieve the shipment target to be eligible for the rewards

The winners will receive an email confirming their reward and the same will be communicated to them by their respective FedEx Sales representative.

The email confirming the winners will be sent to the Participant at the same email address to which the Invitation Email was sent.

Chennai Super Kings match Hospitality tickets will be provided for CSK matches held at the Chepauk stadium
-
Travel and accommodation expenses will not be covered by FedEx and will be the winner's responsibility.
-
The rewards cannot be exchanged for cash, cash-equivalents or any other gifts, goods or service of value and are not transferable.
-
The dates for the match associated with the tickets will be determined solely at the discretion of FedEx.
-
The entitlements included with the tickets, such as seating, hospitality, or other benefits, are subject to the terms and conditions of the tickets.
-
FedEx will not be liable for any costs, expenses, or damages incurred by the winners in connection with attending the match, including but not limited to travel, accommodation, or incidental expenses related to claiming or using the tickets.

Winners of the co-branded cricket FedEx merchandise will receive items determined solely by FedEx. Merchandise items are non-transferable and cannot be exchanged for cash or alternative rewards. This will be shipped to the registered address.

a. Eligibility to participate excludes the directors, management and employees (and their immediate families) of FedEx, its related entities, suppliers, subcontractors, and agencies associated with the Program stated herein as well as employees, agents, officers, and representatives of any government department, government owned entity, juristic person funded by any government department, political party or public international organization, or any candidates for political office.
b. Accounts in cash status / overdue for payment to FedEx / outstanding payment due to FedEx / dispute, all as determined by FedEx in its sole discretion.
c. Customers / account holders who are going through negotiations for contract renewal, participation in new projects, biddings/tenders/request for proposals (RFPs), or any other negotiations that remain pending conclusion during the Program Period; and
d. A government owned or controlled company account and/or accounts owned by government officers
PROGRAM MECHANICS
a. International Priority (IP), International Priority Freight (IPF), FedEx International Economy (IE), FedEx International Economy Freight (IEF), FedEx International Priority® Direct Distribution, FedEx International First®, FedEx® Envelope, FedEx® Pak, FedEx 10kg or FedEx 25kg Box service shipments, spot-rate, Last minute rates (LMR), CS hotline or International Economy Direct Distribution (IED) service shipments.
b. Shipments tendered to FedEx during the Program Period (i.e. shipments tendered by the Participant before the end of the Program Period as notified by FedEx).
c. Shipments billed to a Participant (as indicated in the Program invitation email from FedEx) during the Program period.
REWARDS: SELECTION AND NOTICE OF REWARDS TO RECIPIENT(S)
Rewards will be awarded to, and redound to the benefit of, the registered owner corresponding to a FedEx Account Number qualified to participate under this program as per this set of Terms and Conditions.

The “Meet and Greet” with CSK players will be finalized by FedEx subject to player availability.

Please note, this ticket invite is extended only to the winner and is exclusive and non-transferable. The entitlements that are included as part of the ticket are mentioned in the ticket terms and conditions.

The rewards include only the Hospitality tickets or the “Meet and Greet” with CSK player event.
-
A customer is eligible for a maximum of one category of rewards.

FedEx reserves the right to replace the prizes stated herein with other items of equivalent value without notice.

FedEx will not be liable in the event should one of the following occur:
- Selected winner’s email inbox is full.
- Selected winner’s email inbox has been deactivated.
- The e-mail address provided by a participant is non-existent, incorrect, or incomplete.
- Incorrect and/or inaccurate information including personal information provided by “selected winner” including without limitation name, telephone numbers, e-mail addresses, addresses., etc.
- Delay or failure of any postal operator or of the internet, computer, or any internet service provider.

All Participants are solely responsible for managing their e-mail inbox, including but not limited to checking their e-mail and complying with the instructions for redeeming their prize(s).

FedEx will not be liable for any loss or damage (including but not limited to indirect or consequential loss) which is suffered by a participant or other parties in connection with this Program, including but not limited to personal injury and tax obligations that may arise from accepting any of the rewards, except for any liability which cannot be excluded by law.

FedEx will not be responsible for any expenses and cost including out of-pocket expenses related to or as a consequence of participation in this Program.

No liability can be attributed to FedEx in the event of improper use by the Participant of the prizes or use by people who are unsuitable due to age or physical/mental conditions.

FedEx will not be liable for any malfunction, defect or issue faced with any product(s) or service(s) issued hereunder as prizes for this Program. All guarantees and limitations issued by the supplier in relation to such product(s) and service(s) will apply.

In the event of any inconsistency between these Terms and Conditions and any brochure, marketing or promotional material relating to this Program, these Terms and Conditions will prevail.

By participating in the Program, Participants hereby consent to FedEx and their authorized agents, service providers and business/Country/ Marketing partners to collect, use, disclose, transfer and share the personal data Participants have provided (including across jurisdictions) for:
- purposes of conducting and administering the Program.
- relationship management, sales, marketing, advertising, and promotion purposes or any other purpose as authorized by Participants, or as otherwise required or permitted by law.
GENERAL

Participants also agree that: (i) the consent herein overrides any earlier withdrawal of Participants' consent and will remain effective unless such the consent herein is withdrawn; (ii) the consent herein does not supersede or replace any other consents which Participants may have provided to FedEx, their authorized agents, service providers and/or business/Country/ Marketing partners; and (iii) FedEx, their authorized agents, service providers and/or business/Country/ Marketing partners may contact Participants via any mode and media about products and services offered by FedEx regardless of Participants' registration(s) with any do not contact/call registry.

In addition, Participants hereby represent and warrant that Participants are the user and/or subscriber of the contact details provided by Participants as part of the Promotion.

If this Program is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures, and any other causes beyond the control of FedEx, which corrupt or affect the administration security, fairness, integrity or proper conduct of the Program, FedEx reserves the right in its sole discretion to cancel, terminate, modify or suspend this Program.

In the event of any disagreement between a Participant and FedEx with respect to interpretation of these Terms and Conditions, the decision made by FedEx will be final and no other further correspondence will be accepted. FedEx will not be obliged to award the rewards if it is contrary to any applicable laws or regulations.

FedEx reserves the right to amend these Terms and Conditions at any time without notice.
Shipments
The terms and conditions of carriage in the applicable FedEx Service Guide, in effect on the day of any shipment made by the Participant under the Program, will apply to any such shipments (‘Conditions of Carriage’). If there is a conflict between the Conditions of Carriage and the Program, the Conditions of Carriage will hold.
Complete Agreement
This Agreement, together with the Conditions of Carriage and Account Terms and Conditions, constitutes the entire agreement in place with the customer and supersedes any prior or contemporaneous understandings, representations, statements, or agreements, written or oral. No amendment to, modification of, or waiver of any provision of, this Agreement will be binding on FedEx without FedEx's written consent.
By participating in the Campaign, the participant acknowledges that they have read, understood, and agreed to abide by these Terms and Conditions.
