FABULOUS REWARDS FOR NEW FEDEX CUSTOMERS (“CAMPAIGN”)
CAMPAIGN SPECIFIC TERMS AND CONDITIONS
1. By submitting an entry into this Campaign, you will be deemed to accept these Terms and Conditions.
2. Campaign Period: This Campaign commences on 01 June 2022 at 12:01am Vietnam Time and concludes on 31 July 2023 at 11:59pm Vietnam Time.
3. Entry to Campaign
i. Entry into this Campaign is open to new customers (excluding forwarders and consolidators) who do not have an existing FedEx account and must successfully open a new FedEx account during the Campaign Period (“Eligible Customers”).
ii. Cash accounts are not eligible to participate in this Campaign.
iii. FedEx will only accept one entry per participant. If there are multiple entries per participant, the earliest date of entry will be taken as the valid entry and the other entries will be void. If there are multiple entries with the same date per participant, all the entries by the participant will be void.
iv. If a participant is a FedEx business account, then an individual person may be nominated as its representative (“Nominated Representative”) and enter on the participant’s behalf, but not in his/her own name or on his/her own behalf. Only one Nominated Representative is permitted per participant.
v. Persons under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.
vi. Incomprehensible, objectionable and incomplete entries will be invalid and will not be eligible for the rewards.
vii. FedEx accepts no responsibility for any late, lost or misdirected entries including delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.
4. Privacy Policy:
By submitting your contact information for FedEx new account registration, you hereby consent to Representative Office of Federal Express Pacific, LLC in Ho Chi Minh City (“FedEx Express”), its parent and affiliates (collectively “FedEx”), and their authorized agents, service providers and business/marketing partners to collect, use, disclose, transfer and share the data (including across jurisdictions) for relationship management, marketing, advertising and promotion purposes. These purposes include any other purpose as authorized by you, or as otherwise required or permitted by law. You also agree that: (a) the consent herein overrides any earlier withdrawal of your consent; (b) the consent herein does not supersede or replace any other consents which you may have provided to FedEx, their authorized agents, service providers and/or business/marketing partners; and (c) FedEx, their authorized agents, service providers and/or business/marketing partners may contact you via any mode and media about products and services offered by FedEx regardless of your registration(s) with any do not contact/call registry. In addition, you hereby represent and warrant that you are the user and/or subscriber of the contact details provided by you in the registration form.
5. Rewards; Selection and Notice of Winners
i. First Month Rewards: Eligible Customers who export or import their first shipment within 30 days after their participating account is opened and pay for the shipment on time (the “First Month”) will be entitled to receive one (1) 300,000 VND Esteem voucher and one (1) additional 100,000 VND Esteem voucher if the digital shipping tool, FedEx Ship Manager is used for this first shipment. For the avoidance of doubt, any additional shipments made within the First Month will not entitle the Eligible Customers to receive any additional First Month Reward vouchers. The First Month Rewards Esteem voucher(s) will be delivered to each winner via direct mail two (2) months after their participating account is opened.
ii. Second Month Rewards: Eligible Customers who export or import at least one shipment within days 31-60 of opening days after their participating account is opened and pay for the shipment on time (the “Second Month”) will be entitled to receive one (1) 200,000 VND Esteem voucher.
iii. Third Month Rewards: Eligible Customers who export or import at least one shipment within days 61-90 days of openingafter their participating account is opened and pay for the shipment on time (the “Third Month”) will be entitled to receive one (1) 200,000 VND Esteem voucher.
iv. Eligible Customers who make a cumulative total of at least eight (8) shipments within 90 days of opening their participating account and pay for their shipments on time will be entitled to receive one (1) 500,000 VND Esteem voucher which will be delivered to each winner via direct mail four (4) months after their participating account is opened.
v. The number of shipments is determined based on the number of air waybills. One air waybill equals one shipment.
vi. FedEx reserves the right to replace the reward stated herein with other items of equivalent value without notice. The reward stated herein cannot be exchanged for cash, cash-equivalents or any other gifts, goods or service of value.
vii. Pooling of shipments from multiple accounts is not permitted and such pooled shipments are not eligible to earn rewards in this Campaign.
6. General
i. FedEx shall not be liable for any loss or damage (including but not limited to indirect or consequential loss) which is suffered by a participant or other parties in connection with this Campaign, including but not limited to personal injury and tax obligations that may arise from accepting any of the rewards, except for any liability which cannot be excluded by law.
ii. Eligibility excludes the directors, management and employees (and their immediate families) of FedEx, its related entities, printers, suppliers, providers and agencies associated with the promotion stated herein as well as employees, agents, officers, and representatives of any government department, government owned entity, juristic person funded by any government department, political party or public international organization, or any candidates for political office.
iii. FedEx reserves the right to require the winner(s) to execute a certificate of eligibility prior to awarding the winner(s) with the prize, confirming that the winner is not excluded from entry into this Campaign pursuant to these Terms and Conditions and that the winner(s) has complied fully with these Terms and Conditions. Truthful completion of this certificate is a precondition to the award of the rewards.
iv. By entering this Campaign, unless otherwise advised by the participant, each participant consents to the information they submit being entered into a database which may be used by FedEx in any media for future promotional and publicity purposes.
v. If this Campaign is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures and any other causes beyond the control of FedEx, which corrupt or affect the administration security, fairness, integrity or proper conduct of the promotion, FedEx reserves the right in its sole discretion to cancel, terminate, modify or suspend this Campaign.
vi. The terms and conditions of carriage in the applicable FedEx Express Air Waybill, in effect on the day of any shipment, shall apply to the shipment. If there is a conflict between the terms of the FedEx Express Air Waybill and these Terms and Conditions, the former will control.
vii. In the event of any discrepancies, inconsistencies or inaccuracies with respect to this Campaign, FedEx's decision is final and no other further correspondence will be accepted. FedEx will not be obliged to award the rewards if it is contrary to any applicable laws or regulations.
viii. FedEx reserves the right to amend these Terms and Conditions at any time without notice.
